Daily Elixir provides smoothie and wellness recipes, ingredient information, a blend builder, and related educational content. Recipes, nutrition values, and wellness notes are provided for general informational purposes only.

The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Nutrition values are estimates and may vary with ingredients, brands, and preparation. Statements about ingredients and wellness benefits describe general nutritional properties and have not been evaluated by the Food and Drug Administration or any other regulator.

Always consult a qualified healthcare professional before making significant changes to your diet, especially if you are pregnant, nursing, managing a medical condition, taking medication, or have food allergies. Check every ingredient for your own allergies and intolerances before consuming any recipe.

You must be at least 13 years old to use the App. You agree not to misuse the App, including by attempting to disrupt it, scrape or bulk-copy its content, reverse engineer it, or use it in any unlawful manner.

Saved blends, custom recipes, and preferences are stored locally on your device and belong to you. Because they never leave your device, you are responsible for them: deleting the App or clearing your browser data will permanently erase them, and we cannot restore them.

The App, including its recipes, text, design, illustrations, and the Daily Elixir and Three Little Penguins names and artwork, are owned by Three Little Penguins and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from the App's content without our written permission.

The App is currently free to use. If we introduce paid features or subscriptions in the future, pricing, billing, and cancellation terms will be presented clearly at the point of purchase, and purchases made through the Apple App Store will also be governed by Apple's payment terms.

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that nutritional estimates will be accurate for your specific ingredients.

To the maximum extent permitted by law, Three Little Penguins will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us to use the App in the twelve months before the claim (which, for the free App, is zero).

We may update the App and these Terms from time to time. The "last updated" date above reflects the current version. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in New York, unless applicable consumer law gives you the right to bring a claim in your place of residence.
